Please read this document carefully in order to avoid misunderstandings regarding company policies and terms and conditions of service.

arcplasma.com shall provide its Services to You, the Customer, under the terms and conditions of this document. This agreement is provided to protect the integrity and liability of both arcplasma.com and the Customer. In order to maintain quality of service to all customers, the agreement laid out in this document will be enforced to the greatest extent allowed by law.

arcplasma.com INTERNET ACCESS SERVICES
Access to the Internet is given to You without restriction, provided that You follow the guidelines as laid out in this document.
1. DENIAL OF SERVICE. If You use an excessive amount of bandwidth and prevent other users from accessing the arcplasma.com Services, arcplasma.com reserves the right to terminate Your Service, either temporarily or permanently, at the discretion of arcplasma.com.
2. CONNECTED MACHINES. In order to preserve quality of the Network provided by arcplasma.com, You are only allowed to connect one machine to the Network. If more machines are required, a router or other means of connection exchange must be implemented. Under no circumstances are You allowed to connect any more than one device directly to the Fixed Wireless Network provided by arcplasma.com using a single account.
3. DISCLOSURE OF NETWORK INFORMATION. In order to maintain the security of the Network, You are not allowed to disclose any information pertaining to the Network to anyone not a user of arcplasma.com Fixed Wireless Internet Access Service. Examples of such information include, but are not limited to, Your username and password combination and the WEP key or ESSID of any arcplasma.com access point.

arcplasma.com EMAIL SERVICES
Access to arcplasma.com email servers is given to You without restriction provided that You follow the guidelines as laid out in this document.
1. NUMBER OF EMAIL ADDRESSES. You are allowed to create, modify, maintain, utilize, and delete as many email addresses as Your level of service grants you, as specified on the arcplasma.com website.
2. EMAIL ADDRESS MANAGEMENT. You are allowed to manage Your email addresses using the interface provided to You by arcplasma.com.
3. ACCESS OF EMAIL ADDRESSES. You are not allowed to access any email address that does not belong to Your user account. This includes, but is not limited to, sending messages from any other account, checking, downloading, reading, and deleting any messages stored on the server that are not explicitly owned by You.
4. SPAMMING. You are not allowed to send spam of any type, including but not limited to, duplicative messages, blank messages, and unsolicited messages (commercial or otherwise). arcplasma.com, at its sole discretion, will prevent You from engaging in such activities by any means, including termination, whether permanent or temporary.
5. MAILBOX QUOTAS. arcplasma.com may, at its sole discretion, may choose to implement a mailbox quota for any email address at any time, to preserve resources and maintain utmost quality of service to all customers. You are required to abide by this mailbox quota if it is placed on Your email address.
6. UNUSED EMAIL ADDRESSES. arcplasma.com, at its sole discretion, may remove any email address that is not being used. Any email messages that are left on the arcplasma.com server for an excessive period of time can be removed by arcplasma.com in order to preserve system resources.

EQUIPMENT AND SERVICING
arcplasma.com makes every attempt to provide the highest quality support for all of its customers. However, due to limited resources, arcplasma.com is only able to service equipment purchased directly from arcplasma.com. Equipment purchased from a third party must be serviced by another party.

CONNECTIVITY ISSUES
From time to time, users may experience connectivity issues. In the event of a connectivity issue, arcplasma.com will attempt to correct any errors that incur on its end, and will repair, at no cost to the Customer, any problems at the client end that are the fault of arcplasma.com. If the connectivity issue is found to be the fault of the Customer, the Customer agrees to supply payment for all on-site service provided by arcplasma.com, using the pricing as provided by arcplasma.com. Due to the volatile nature of radio frequency technologies and the many unforeseen problems that may arise as a result, arcplasma.com cannot guarantee connectivity of any customer at all times. arcplasma.com will not under any circumstances be held responsible for loss of connectivity or poor connectivity due to band conditions and propagation. arcplasma.com will suggest alternative connection methods, including but not limited to external antennas and amplifiers, that will provide an optimal connection if such problems arise. The customer will be responsible for deciding whether or not to use such methods, but arcplasma.com reserves the right to refuse service to customers experiencing connectivity issues under these circumstances if no action is taken to overcome band condition or propagation problems. THERE IS NO WAY TO ENSURE THAT A CUSTOMER WILL RECEIVE OPTIMAL CONNECTIVITY AT ANY GIVEN TIME BECAUSE BAND CONDITIONS CHANGE WITHOUT ANY PREDICTABILITY AND ARE NOT MEASURABLE.

HARDWARE USAGE, SALES & SERVICE
arcplasma.com recommends You purchase hardware directly from arcplasma.com. Hardward sold by arcplasma.com has been tested for compatability with our network and can be replaced by arcplasma.com in the event of failure. arcplasma.com will not support any hardware purchased from a third party. arcplasma.com will not assume any responsibility for any issues relating to the use of hardware not purchased from arcplasma.com. arcplasma.com will replace hardware purchased from arcplasma.com, IF AND ONLY IF you retain the original retail packaging for the failed device. arcplasma.com CANNOT replace any items not in original retail packaging.

YOUR RESPONSIBILITIES
By using arcplasma.com Services, you must agree to the following:
1. Provide true, current, and complete information to arcplasma.com whenever it is required by arcplasma.com. If arcplasma.com has any reason to believe that Your information is untrue, inaccurate, outdated, or incomplete, it can, at its sole discretion, choose to terminate Your Service.
2. Inform arcplasma.com of any and all changes to any data that may be required by arcplasma.com at any time. If arcplasma.com has any reason to believe that Your information is not maintained as being true, accurate, current, and complete, it can, at its sole discretion, choose to terminate Your Service.
3. You are responsible for maintaining the confidentiality of your account credentials, including your username and password, and will be held responsible for all activities that occur using your credentials.
4. To protect yourself and arcplasma.com from fraudulent activity, or activity that otherwise violates the terms in this document, it is your responsibility to inform arcplasma.com of any unauthorized use of your account credentials, or other breech of security of which you are aware. arcplasma.com will not be held responsible for any damage or loss resulting from your failure to comply with this policy.
5. No customer is to access the arcplasma.com servers without the explicit permission of arcplasma.com, and under no circumstances are security protocols to be bypassed when accessing any arcplasma.com Service. Furthermore, it is strictly forbidden for any customer of arcplasma.com to access the server with administrative privileges.
6. You are only allowed to access the Network by using the credentials provided to You. If You use any other credentials other than those provided explicitly to you by arcplasma.com, arcplasma.com, at its sole discretion, may choose to take any action necessary, including but not limited to permanent or temporary termination of Service.

INITIALIZATION FEE
Upon completion of the setup process by an arcplasma.com technician, all arcplasma.com customers are charged an initialization fee. This fee covers the setup of basic hardware, addition to the network, authentication, etc. The initialization fee also covers Internet access until the due date of the next statement. Before any customer is allowed access to the arcplasma.com network services, the initialization fee must be paid. If the initialization fee is not paid by a customer, he or she will not be allowed to access arcplasma.com network services until the time at which the initialization fee is received. An initialization fee is required to be paid by a customer whose service has been terminated for any reason. If Your service was terminated due to non-compliance with any part of this document or any other reason, You will be charged the initialization fee again. Your account will remain terminated until a time at which arcplasma.com receives the initialization fee in full.

PAYMENT POLICIES
In order for arcplasma.com to provide the highest quality service to all customers, it is Your responsibility to ensure that your payment is delivered to arcplasma.com by the due date printed on the statement You receive. Failure to comply with this policy will result in additional fees, due by the due date of the following invoice. If both invoices and additional fees are not received by arcplasma.com within three days of the due date of the invoice, You will be temporarily terminated from arcplasma.com Services, until the time at which arcplasma.com does receive payment in full for all invoices and fees. Payments will only be accepted for invoices on record and advance payments for automated invoices, including but not limited to monthly service bills, are not allowed. If such payments are received by arcplasma.com, they will be held without posting until a time at which an appropriate invoice is created toward which it may be applied. arcplasma.com cannot be held responsible for any payment held while awaiting an invoice.

TERMINATION
arcplasma.com, at its sole discretion, may terminate your account, in whole or in part, or any use of arcplasma.com Services, temporarily or permanently, and remove and discard any information it deems necessary affiliated with your account at any time.

NO UNLAWFUL OR PROHIBITED USE
You are not allowed to use any Service provided by arcplasma.com for any purpose that is unlawful or prohibited by this document, or any other document that applies to You, arcplasma.com, the Services, or any local, state, or federal law. You may not gain or attempt to gain access to any unauthorized portion of any arcplasma.com, including, but not limited to, other accounts, Services, computers, computer systems, and networks, through any means.

THIRD PARTY AFFILIATIONS
Any affiliation with one or more third parties is the sole responsibility of the Customer, and arcplasma.com will not be liable or responsible in any way for any actions, whether desirable or not, that take place between you and the third party.

NO WARRANTY
arcplasma.com provides no warranty, either expressed or implied, to the extent applicable by law, and the service is provided "AS-IS" and arcplasma.com assumes no responsibility for any damages caused by the use of arcplasma.com Services. Under no circumstances unless required by applicable law or other agreement shall arcplasma.com be held liable for any damages, including any general, special, incidental, or consequential damages arising from the use of or inability to use arcplasma.com Services, including, but not limited to, loss of data, data being rendered inaccurate or unusable, losses sustained by You or one or more third parties.

arcplasma.com reserves the right to change this document, in whole or in part, at any time. This document it subject to change without notice to You, and you are responsible for knowing, understanding, and agreeing to the terms in the most updated version of this document.
